Koe Album Terms of Service

These Terms of Service (hereinafter referred to as "these Terms") set forth the conditions for using the smartphone application "Koe Album" (hereinafter referred to as "the App") provided by the operator of the App (hereinafter referred to as "the Operator"). Users (hereinafter referred to as "Users") are required to agree to these Terms before using the App.

Article 1 (Application)

These Terms apply to all matters relating to the use of the App between Users and the Operator.

Article 2 (Definitions)

In these Terms, the following terms have the meanings defined below.

  1. "the Service" refers collectively to all features provided through the App, including audio recording, storage, sharing, AI transcription, AI weekly summary generation, etc.
  2. "the App" refers to the smartphone application "Koe Album" provided by the Operator.
  3. "Users" refers to all individuals who use the App.
  4. "AI Features" refers to the audio transcription feature and weekly summary generation feature that utilize the Gemini API provided by Google LLC
  5. "Family" refers to a group that a User creates or joins within the App.
  6. "Paid Plan" refers to the paid auto-renewable subscription "Koe Album Premium" provided by the Operator.

Article 3 (Registration and Account)

  1. Users shall register to use the App by completing email authentication or other methods prescribed by the Operator.
  2. Users shall manage their accounts under their own responsibility and shall not allow third parties to use, lend, transfer, change the name of, or sell their account information.
  3. The Operator may reject a registration application in the following cases:
    • When false information has been submitted
    • When the application is from a person who has previously violated these Terms
    • When the Operator otherwise deems the registration inappropriate

Article 4 (Service Content)

The App provides the following features.

  1. Audio recording: A feature that allows Users to record audio
  2. Cloud storage: A feature that stores recorded audio data on a cloud server (Supabase)
  3. Family sharing: A feature that allows sharing of audio data among Family members who have been invited
  4. AI transcription: A feature that automatically converts recorded audio to text using Google Gemini API
  5. AI weekly summary: A feature that automatically summarizes one week's recordings using Google Gemini API
  6. Calendar display: A feature that displays recorded data by date

Audio data and AI-generated content are accessible only to the User and Family members invited by the User.

Some features of the App are subject to usage limits (such as the number and duration of recordings) under the free plan. Subscribing to the Paid Plan relaxes or removes these limits and provides additional benefits such as ad-free use (see Article 7). Third-party advertisements are displayed under the free plan.

Article 5 (Use of AI Features)

  1. The App's AI features use the Gemini API (gemini-2.5-flash) provided by Google LLC
  2. When using AI features, Users' audio data is sent to Google LLC for the purpose of transcription and summary generation.
  3. Users' audio data and transcription text are not used for AI model training purposes.
  4. The Operator does not guarantee the accuracy or completeness of content generated by AI features (transcription text, weekly summaries, etc.).
  5. The use of AI features is also subject to Google LLC's Terms of Service and Privacy Policy.

Article 6 (Third-Party Services)

The App uses the following third-party services.

  1. Supabase Inc.: Database and storage services
  2. Google LLC (Gemini API): AI transcription and summary generation
  3. Google LLC (AdMob): Advertising
  4. Google LLC (Firebase): Authentication, analytics, and push notification delivery
  5. RevenueCat, Inc.: Subscription management and billing processing
  6. Functional Software, Inc. (Sentry): Error and crash reporting

The use of these services is subject to the respective service providers' Terms of Service and Privacy Policies.

Article 7 (Paid Plan and Payments)

  1. The Operator offers a paid auto-renewable subscription, "Koe Album Premium," available as a monthly plan or an annual plan. The title, length, and price of each plan are displayed on the in-app purchase screen before purchase.
  2. Purchases and payments for the Paid Plan are processed through the App Store provided by Apple Inc. or Google Play provided by Google LLC, and the fee is charged to the User's Apple Account or Google account.
  3. The Paid Plan automatically renews, and the fee for the next period is charged, unless the User cancels auto-renewal at least 24 hours before the end of the current subscription period.
  4. Auto-renewal can be canceled in the device settings (iOS: Settings → [your name] → Subscriptions; Android: Google Play app → Subscriptions). Simply deleting the App does not cancel the subscription.
  5. If a free trial is offered, the subscription automatically converts to the Paid Plan and the fee is charged unless auto-renewal is canceled before the end of the trial period.
  6. After cancellation, Users may continue to use the Paid Plan features until the end of the paid subscription period. No prorated refunds are provided.
  7. Refunds of paid fees are subject to the refund policies and procedures of Apple Inc. or Google LLC.
  8. The Operator may change the content and pricing of the Paid Plan. Price changes will be notified or displayed to Users in advance and will apply from the first renewal after the change.

Article 8 (Prohibited Activities)

Users shall not engage in the following activities when using the App.

  1. Activities that violate laws, regulations, or public order and morals
  2. Activities related to criminal acts
  3. Activities that infringe on the intellectual property rights, portrait rights, privacy, reputation, or other rights or interests of the Operator, other Users, or third parties
  4. Activities that destroy or interfere with the functions of the Operator's servers or networks
  5. Activities that may interfere with the operation of the App
  6. Unauthorized access or attempts thereof
  7. Collecting or accumulating personal information about other Users
  8. Using the App for unauthorized purposes
  9. Impersonating other Users
  10. Advertising, solicitation, or commercial activities on the App not approved by the Operator
  11. Activities that directly or indirectly provide benefits to antisocial forces
  12. Reverse engineering, decompiling, disassembling, or similar activities related to the App
  13. Other activities deemed inappropriate by the Operator

Article 9 (Suspension of the App)

  1. The Operator may suspend or interrupt the provision of all or part of the App without prior notice to Users if the Operator determines that any of the following reasons exist:
    • When performing maintenance, inspection, or updates of the computer systems related to the App
    • When the provision of the App becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
    • When computers or communication lines are interrupted due to an accident
    • When the Operator otherwise determines that the provision of the App is difficult
  2. The Operator shall not be liable for any disadvantage or damage incurred by Users or third parties due to the suspension or interruption of the App.

Article 10 (Rights to Audio Data)

  1. The copyright of audio data recorded by Users through the App belongs to the Users.
  2. The Operator may duplicate, store, and transmit Users' audio data for AI processing to the extent necessary for providing the Service.
  3. Users may delete their own audio data at any time through the App's features.
  4. When an account is deleted, all data associated with that User (audio data, transcription text, AI summaries, etc.) will be deleted.

Article 11 (Disclaimer)

  1. The Operator does not warrant, either expressly or implicitly, that the App is free from defects in fact or in law (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, infringement of rights, etc.).
  2. The Operator shall not be liable for any damage caused to Users arising from the App, except in cases of intentional or gross negligence on the part of the Operator. However, this disclaimer shall not apply if the contract between the Operator and the User regarding these Terms constitutes a consumer contract as defined in the Consumer Contract Act.
  3. The Operator makes no guarantees regarding the accuracy, appropriateness, or completeness of content generated by AI features.

Article 12 (Changes to Service Content)

The Operator may change the content of the App or discontinue the provision of the App without notifying Users, and shall not be liable for any damage caused to Users as a result.

Article 13 (Changes to Terms of Service)

  1. The Operator may change these Terms at any time without notifying Users if deemed necessary.
  2. The revised Terms of Service shall take effect from the time they are displayed on the App.
  3. If a User continues to use the App after these Terms have been changed, the User shall be deemed to have agreed to the revised Terms.

Article 14 (Handling of Personal Information)

Users' personal information obtained through the use of the App shall be handled appropriately in accordance with the Privacy Policy separately established by the Operator.

Article 15 (Notices and Communications)

Notices or communications between Users and the Operator shall be made by the methods determined by the Operator.

Article 16 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer their contractual status or any rights or obligations under these Terms to a third party, or provide them as security, without the prior written consent of the Operator.

Article 17 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. In the event of any dispute arising in connection with the App, the court having jurisdiction over the location of the Operator's headquarters shall have exclusive agreed jurisdiction.
